The federal government should not tell states how to regulate natural gas operations within their borders, the American Petroleum Institute (API) told a U.S. Department of Energy (DOE) panel in formal remarks on the panel's preliminary findings.

"While the industry and states are constantly striving to improve operations, it is important to recognize the strong foundation for shale gas operations that currently exists through robust state regulatory programs in most parts of the country," API said. "Rather than deferring on the proper role of state governments, we recommend the Subcommittee acknowledge the success that has been demonstrated through state-level programs. Regulation of oil and natural gas has been led by states since the inception of the industry and has demonstrated a high degree of capability and flexibility in adapting to changes such as those seen with unconventional gas development. States have created systems that effectively protected the environment, including ground water and drinking water sources."

Other remarks by the industry group included:
  • "API supports a strong state regulatory framework for natural gas and the dedication of appropriate resources and staff to carry out the regulatory functions. The Subcommittee should defer to the states on the question of how to generate the necessary funding for regulatory programs, rather than making this determination for the states.
  • "..[W]e are concerned that the Subcommittee did not engage in a gap analysis to determine whether, and to what extent, the items included in its recommendations have been or are being addressed by state and federal regulators, academia, industry or third parties. . . . A benefit-cost analysis is critical to balanced decisions related to the regulation of commercial activity.
  • "API agrees that the protection of water resources is a top priority for all industry operations including hydraulic fracturing. However, water is a highly regulated commodity subject to the federal Clean Water Act as administered by the federal government and the states. A systems approach is already occurring in most local, state, and interstate jurisdictions due to the many requirements associated with water allocation and management processes. In addition, in most states, there already exists a reasonable manifest system for tracking wastes to their point of disposal. We see little additional value from requiring a manifest for the transportation of fresh water hauls since most water management agencies require reporting of these volumes already. This type of requirement should be reserved for those elements posing the greatest risks."

Among other things, API also protested the DOE panel's proposal to regulate air quality emissions from fracking operations separately. "Shale gas operations are already subject to a myriad of federal (Clean Air Act) and state air emissions regulations that have been in place for many years and continue to evolve," API said. "States must often obtain primacy by having programs as or more stringent than the federal requirements in meeting human health and environmental goals."

API supported the panel's recognition that shale gas provides important energy and economic contributions to the U.S.

Magnum Hunter announced several management changes in the Company's finance department. Victor Ponce de Leon is being transferred in a lateral position and will now work at two of the Company's wholly-owned subsidiaries, Eureka Hunter Pipeline, LLC and Energy Hunter Securities, LLC.

Mr. Ponce de Leon has over 15 years of experience in the energy sector, with the last two years having served as Vice President of Finance and Treasurer at Magnum Hunter. He has previous experience as an Investment Banker with Morgan Keegan and West LB, having worked on numerous energy related transactions, including structured and corporate financings, mergers and acquisitions and fairness opinions. Mr. Ponce de Leon has also worked as an equity research analyst covering the exploration and production sector for CIBC World markets, Credit Lyonnais and Jeffries & Co. He received a B.B.A. in Finance from the University of St. Thomas and a Certificate in Accounting from the University of Houston.

Additionally, the Company has promoted E. Gabe Scott to Assistant Vice President of Finance and Assistant Treasurer of the Company. Mr. Scott has been an employee of Magnum Hunter since January 2011. He has five years of corporate finance experience with increasing management responsibilities in the energy sector, having spent the last year as a Financial Analyst for the Company. His work related experience include four years in Senior Financial Analyst positions with an upstream energy company, an energy sector focused private equity firm and with a multinational global financial services provider. Mr. Scott was a full scholarship recipient and four year letterman in baseball at the University of Alabama receiving numerous honors and recognition such as serving as team co-captain for several years, being named an ESPN Academic All-American, recognized as the Outstanding Finance Undergraduate Student for two years, a Paul Bear Bryant Student Athlete of the Year Finalist in 2005, a National Collegiate Baseball Writers Association All-American in 2005, and a First Team All Southeastern Conference choice in 2005 amongst many other awards for both his academic and athletic achievements.

AGR Field Operations has established a new Advisory Services department. AGR Field Operations has previously provided early life asset and project services as part of the standard offering under different product lines.

The establishment of the Advisory Services department strengthens the company's focus on pre-operational and early life asset integrity support. The move will consolidate and provide a focal point for the delivery of these services to Oil and Gas companies, asset owners, fabricators, EPC and project management companies. The new department will have its Centre of excellence in Norway and will expand to all AGR hubs worldwide with immediate effect.

Åge Landro, EVP AGR Field operations commented, "The launch of our Advisory Services department complements our unique position in the industry. We have gained this position due to our experience and involvement across the entire lifecycle of oil and gas assets. We participate through all stages, from concept and engineering to O&M and decommissioning. Advisory Services will focus on the phases starting with planning, through feasibility, concept definition and execution. We wish to help our clients establish the foundations for optimal operational performance at an early stage of the asset lifecycle."

The department will be led by Thomas Aas Sæthre who previously held the position of Section Manager within Maintenance Engineering.
